Are Your Gun Rights Safe in California?

When it comes to gun rights most Californian gun owners have learned from experience to have a very healthy distrust of state government. There is a long and ample history of the state legislature attacking the second amendment and passing oppressive laws.

And yet again, there seems to be yet another assault on responsible gun ownership in California with Senate Bill 18 introduced by Senator Richard Pan.

Responsible gun owners in California face the possibility that their children could be taken from them if they keep guns in the house.

Why and how?

On December 5th, 2016 Senator Richard Pan introduced a bill called SB18 Bill of Rights for Children and Youth in California.

How can this bill possibly be related to gun ownership? Right now we do not know exactly how and it requires a bit of educated guesswork. Let’s look into some background information and then connect the dots.

At first glance, the bill seems great. Each and every child deserves to have loving parents to protect and take care of them. And as each person parents in their own way, this can be accomplished through various parenting styles.

And here is where I started to read between the lines.

Let’s start with a few highlights of California’s most recent gun right abuses. Have you heard of the Armed Prohibited Persons System (APPS)? This group is authorized to collect guns from citizens that it deems to be “prohibited” from gun ownership. All the state has to do is declare that a person is unfit. They do not have to be a convicted criminal and the search is warrantless.

I also know of a man who recently was told in divorce court to relinquish all of his guns for a minimum of six months until his daughter could take a gun safety course. It didn’t matter that all of his guns were locked safely away in a safe or that there is not a law that requires it. The judge made the decision and that was that.

Another example is AB1014 which started in California in January 2016. Family members can get a temporary restraining order against family members they think should not possess guns due to a mental illness. While this law has its merits, the only evidence required to get the process started is a “gut feeling”.

And these are only a few examples that lead me to question #SB18.

What if your local school learned of your gun ownership and reported you to the state for no other reason that you simply own guns? What if you are in the middle of a divorce and your spouse decides that your gun ownership threatens the safety of your children and reports you. There are so many realistic situations that could be possible.

And while the bill in its current format does not mention gun ownership, the vague language of the bill coupled with the immense amount of infringements on our second amendment rights in California, makes these kinds of assumptions very plausible.

What we do suspect pretty confidently is that should this bill become law, it will transfer the final say of children’s lives from parents to Californian governmental authorities. And it applies to literally every aspect of a child’s life including healthcare, nutrition, education, child welfare services, foster care, and homeless assistance. And worse, it could allow them to take your children if you do not follow their rules.

Yes, you read it correctly, Californian parents will not have the final say in their children’s lives should this bill pass into law. If that doesn’t scare you as a parent, I am not sure what else will.

The biggest problem with this bill is that the government will decide what constitutes health, safety, well-being, early childhood and educational opportunities, and familial supports necessary for all children to succeed. They will decide what are “researched based essential needs”.

This might or might not coincide with an individual’s family values, like the right to bear arms. And the vagueness of this bill is what makes it so scary. Californian government officials could easily decide that that guns in the home with children present are dangerous.

Given that California has repeatedly and historically passed more and more anti-gun laws, it is conceivable that gun owners with children will be targeted. This kind of blanket ticket to decide what is and what is not good for your child is not the kind of power that we want to give away.

The bill is backed by the Right Start Commission. Many of their suggestions are just as bad regarding parental rights such as mental health screenings and health check-ups from zero to age 5. Health care should be left up to parents, not the Right Start Commission or any other governmental agency. If this bill is made into law it is highly likely that their “suggestions” will be mandated.

There are many reasons that this bill is bad, but the most important reason to focus on is that this is an assault on parental rights.

What can you do?

Our best course of action right now is to take three vital steps.

  1. Tell everyone you know in California about this bill.

  3. Phone (better) or email (not as effective) your Senator and Assembly Person and ask them to not co-sponsor this bill or support it in any way. Meeting face to face can make the biggest impact. It is important to emphasize that this bill is too vague and leaves too much open for interpretation and thus ample room for abusive powers by our government.

Dr. Richard Pan thinks the state knows best and is willing to do anything he can to take away parental rights should you not agree with his vision of proper parenting. He is backed by very powerful special interest groups that are hell-bent on forcing their “standard of care”  into every family. This bill is their key to get into your family and take away what they want.

Finally, if you are not a California resident, “why should you care?” The answer is simple, California is the “testing” ground for these kinds of sweeping laws that destroy our rights little by little until it is too late. Once they are done here, they will move on to the next states, with practice and experience.

Don’t let that happen. Get active and protect your rights.
